These Terms govern your use of our Website and related digital channels (including WhatsApp links on the Website). They do not replace the credit agreement you sign if your loan application is approved. Where you conclude a loan with us, the credit agreement + disclosure documents + debit order mandate will apply in addition to these Terms.

1.2 Registered credit provider: regulated under the National Credit Act 34 of 2005 ("NCA") and registered with the National Credit Regulator ("NCR").

2Definitions
In these Terms:
- "Website" means pcfinloans.co.za and any pages, forms, tools, and content available on it.
- "User/you" means any person accessing or using the Website.
- "Services" means information services and online functionality offered through the Website, including enquiry and loan application functionality.
- "Credit Agreement" means the written/electronic credit agreement and related documents concluded between you and us if your application is approved.
- "Data Message" has the meaning assigned in the Electronic Communications and Transactions Act 25 of 2002 ("ECTA").
3Acceptance and Binding Effect
3.1 By accessing, browsing, using the Website, submitting an enquiry, or completing any online form, you agree to these Terms.
3.2 If you do not accept these Terms, you must stop using the Website.
3.3 You warrant that you are legally entitled to access the Website and have legal capacity to contract.
4Changes to These Terms
4.1 We may amend these Terms at any time by publishing the updated version on the Website.
4.2 The version displayed on the Website at the time you use it will apply.
4.3 Your continued use of the Website after changes means you accept the updated Terms.
5Nature of Website Content (No Advice)
5.1 Website content is provided for general information only and is not financial, legal, tax, accounting, or other professional advice.
5.2 You should obtain independent advice where appropriate before making decisions that may affect your finances.
6Credit Marketing, Applications, and Approvals
6.1 Content describing our loan products is an invitation to do business and not a binding offer.
6.2 Any application is subject to lawful verification, fraud checks, affordability assessment, and our credit policies.
6.3 We may decline any application where required by law or where our assessment indicates the credit is not affordable or otherwise not appropriate.
6.4 Where your application is approved, the Credit Agreement (and related disclosures and mandates) governs the loan—not these Terms.
7Eligibility (Age and Identity)
7.1 The Services are intended for persons 18 years or older.
7.2 You may not use the Website to apply for credit if you are under 18 or lack legal capacity.
7.3 You warrant that all information you provide is true, correct, and complete.
8Communications and Electronic Contracting (ECTA)
8.1 You agree that we may communicate with you electronically via the contact details you provide (email, SMS, WhatsApp, or other digital channels), subject to our Privacy Policy and applicable law.
8.2 If you conclude a Credit Agreement electronically, you consent to the use of electronic signatures, tick-box acceptances, one-time pins (OTPs), and Data Messages where permitted by law and agreed in the credit documentation.
8.3 You agree that electronic records, system logs, timestamps, OTP confirmations, IP/device data, and Data Messages generated by our systems (or our service providers' systems) may be used as evidence of your actions and acceptance, subject to applicable law.
9Debit Order Repayments (Website-Level Notice)
9.1 If your credit application is approved, repayment is collected via debit order from the bank account you nominate, in accordance with the debit order mandate and the Credit Agreement.
9.2 You warrant that:
- (a) the banking details you provide are accurate; and
- (b) you are authorised to use and debit the nominated account.
9.3 You are responsible for ensuring sufficient funds are available on the scheduled deduction date(s).
9.4 Returned/unpaid debits may result in arrears and may trigger steps allowed by the Credit Agreement and the NCA (including lawful collections activity and credit bureau reporting where permitted).
9.5 Changes to bank details must be requested via our official channels and may require verification. A change is effective only once confirmed by us.
10Privacy, POPIA, and Consent
10.1 We process personal information in accordance with our Privacy Policy and South African law, including the Protection of Personal Information Act, 2013 (POPIA).
10.2 By submitting information on the Website, you acknowledge that we may process your information for lawful purposes including: identity verification, affordability assessment (including credit bureau checks where applicable), fraud prevention, customer communication, and compliance with legal obligations.
10.3 Direct marketing (if any) will be conducted only where permitted by law and subject to opt-out rights.
11Security and User Responsibility
11.1 We take reasonable measures to secure the Website and protect information. However, no internet system is completely secure.
11.2 You are responsible for:
- protecting your device, email account, and phone;
- keeping any OTPs, passwords, or access codes confidential; and
- notifying us promptly if you suspect unauthorised access.
12Website Availability and Maintenance
12.1 The Website is provided "as is" and "as available".
12.2 We may modify, suspend, withdraw, or restrict access to the Website at any time for security, maintenance, legal compliance, or business reasons.
12.3 We do not guarantee uninterrupted or error-free access.
13Accuracy of Information on the Website
13.1 We strive to keep information current and accurate, but we do not warrant that all Website content is complete, up to date, or error-free.
13.2 You use and rely on Website content at your own risk.
14Prohibited Use (Acceptable Use Rules)
You may not:
- 14.1 use the Website for unlawful purposes or in breach of South African law;
- 14.2 attempt to gain unauthorised access to the Website, systems, or data;
- 14.3 introduce malware, viruses, bots, or harmful code;
- 14.4 scrape, crawl, reverse engineer, or use automated tools to extract data without our written consent;
- 14.5 submit false, misleading, or fraudulent information;
- 14.6 misuse WhatsApp/contact links for harassment, spam, or abusive communication.
We may block access, report misuse, and take legal action where appropriate.
15Intellectual Property
15.1 All content on the Website (text, graphics, layouts, logos, software, and database rights) belongs to us or is used under licence and is protected by intellectual property laws.
15.2 You may view and print pages for personal, non-commercial use.
15.3 You may not reproduce, distribute, modify, publish, or exploit Website content without our prior written consent.

16.1 You may not frame the Website or create links that misrepresent association, endorsement, or sponsorship without our prior written approval.

19Indemnity

21.1 These Terms are governed by the laws of the Republic of South Africa.
21.2 You consent to the jurisdiction of South African courts for disputes arising out of these Terms or your use of the Website.
22General Legal Provisions
22.1 Severability: If any provision is invalid or unenforceable, the remaining provisions remain in force.
22.2 No waiver: Failure to enforce any right is not a waiver of that right.
22.3 Entire agreement (Website use): These Terms and the Privacy Policy constitute the entire agreement between you and us regarding Website use.
22.4 Assignment: We may cede, assign, or transfer our rights and obligations under these Terms to a third party as part of business continuity, restructuring, or sale, subject to applicable law.
22.5 Headings: Headings are for convenience and do not affect interpretation.
